While there are several "grounds" for divorce in
Massachusetts, one type of divorce is commonly referred to as
"no-fault". A no-fault divorce is another way of stating that there
are irreconcilable differences or that there has been an
"irretrievable breakdown" of the marriage. Parties who are able to
amicably resolve all the issues that pertain to their divorce may
jointly and voluntarily enter into a "no-fault" divorce. Some of the
issues that may need to be addressed and resolved include, but are
not limited to:
• child custody • child support •
visitation • alimony or financial support • division of the
marital assets • In this situation, only limited court
intervention is necessary to finalize the divorce.

themselves in a “contested divorce” that can be demanding,
emotional, and time consuming. In those situations, several factors
will be addressed by a judge in the Probate Court who will
ultimately render a decision on such issues as custody, support,
visitation, and division of property.
The factors the judge will consider include the following:
• the length of the marriage • the income, station in life,
education & health of the parties • conduct of the parties
during the marriage • the respective contribution of the parties
to the marital assets • determining what is in the best interest
of the children
