Child Support / Alimony

Detail-Oriented Child Support and Alimony Advocacy

When it comes to finances, a peaceful divorce can get out of control where both sides lob accusations of hiding income. With so much at stake, you need an attorney to find a resolution. At the Massachusetts-based law firm of Yellin & Hyman, P.C., we provide that level of representation and protect the rights of our clients paying or receiving child support and alimony.

For help with a contentious child support or alimony matter, contact us today. We offer two convenient area locations (Franklin and Hyde Park) and can be reached via phone by calling 508-570-4581 or 617-910-3664 or via e-mail.

Getting to the Facts of Child Support

Child support is determined by calculating both spouses' income. From those amounts, a formula is applied based on the guidelines set forth in Massachusetts law, (known as the "Child Support Guidelines"). The process itself can be abused if either party is dishonest in providing information regarding their income, expenses and/or assets. The final number needs to be based on accurate information related to what spouses earn. Our job is to determine and properly analyze all sources of a spouse's income.

At Yellin & Hyman, P.C., our job is to get to the facts. We do this by having an attention to detail and by enlisting the help of forensic accountants and other financial professionals.

Determining Alimony Based on Various Factors

Alimony, unlike child support, is not governed by a statutory formula or guideline. Spousal support is discretionary in nature, is not guaranteed in every divorce and is based on a number of factors which include both spouses' needs, length of marriage, income, their health and ages, their respective work experiences and the overall ability of either one to pay. Current employment status and future earning capacity are also examined.

The process itself makes it vital to have a locally based, experienced attorney who understands the discretionary nature of the process and can make persuasive arguments in your favor after a thorough examination of the factors considered by the court.
